Terms of Use

Nomi is a free AI wine-guidance service provided by hey.wine AG, available via WhatsApp. By using Nomi you accept these Terms of Use. For information on data protection, see our Privacy Policy.

§ 1 · Provider and Service

1.1 Nomi is an AI-powered wine-guidance service operated by hey.wine AG (in formation), Zurich, Switzerland (hereinafter “hey.wine” or “we”).

1.2 Nomi is available via WhatsApp and builds a personalized wine profile for you through conversation. The service is free for end users.

1.3 Nomi provides recommendations and refers you to wine retailers. Nomi does not sell wine itself and is not party to any purchase.

§ 2 · Eligibility

2.1 Nomi may be used by anyone who has an active WhatsApp account and meets the minimum age for using WhatsApp in their country (generally 16).

2.2 Because Nomi provides wine recommendations and wine is an adult product, we assume that you meet the legal minimum age for purchasing alcoholic beverages in your country. In Switzerland and Germany this is 16 for wine; in the United Kingdom and many other countries it is 18.

2.3 Nomi is not intended for commercial reuse. Automated queries, scraping, or API-like use are not permitted.

§ 3 · Scope and Limitations

3.1 Nomi provides personalized wine recommendations based on your conversations. These recommendations are independent and are not influenced by commercial arrangements with retailers or wineries.

3.2 Nomi gives no warranty for:

  • the availability of recommended wines at the respective retailer;
  • the accuracy of price information – this comes from third parties;
  • the completeness of the wine selection covered;
  • the continuous availability of the service.

3.3 Nomi's recommendations are suggestions, not promises to buy. hey.wine is not party to any purchase contract between you and a wine retailer.

3.4 Nomi can make mistakes. AI-generated recommendations should not be understood as professional wine advice in a legal sense.

§ 4 · Your Wine Profile and Your Data

4.1 Nomi builds a wine profile from your conversations – a so-called taste graph. It contains information about your preferences, not about your identity.

4.2 You can request deletion of your profile at any time. Simply write “delete profile” in the chat or send an email to info@hey.wine.

4.3 Nomi does not share your personal data with retailers or wineries. Retailers receive only aggregated, anonymized demand analytics.

§ 5 · Acceptable Use

5.1 You agree not to use Nomi for abusive purposes, in particular not:

  • to spread misinformation or misleading content;
  • to circumvent technical protection measures;
  • to use it on behalf of third parties without their knowledge;
  • for automated bulk retrieval of product data.

5.2 hey.wine reserves the right to exclude users from the service in case of abuse.

§ 6 · Liability

6.1 hey.wine is not liable for damages arising from the use of Nomi's recommendations, in particular not for:

  • purchasing decisions made on the basis of Nomi's recommendations;
  • the quality, delivery, or handling of purchases at linked retailers;
  • outages or delays of the WhatsApp service.

6.2 This limitation of liability does not apply in cases of intent or gross negligence by hey.wine, nor in cases of personal injury.

6.3 hey.wine is not responsible for the content of linked third-party sites (retailers, wineries).

§ 7 · Changes to the Service and these Terms

7.1 hey.wine may change, restrict, or discontinue the service at any time. In the event of material restrictions, reasonable advance notice will be given.

7.2 Changes to these Terms of Use will be communicated via the WhatsApp channel or by notice on hey.wine. Continued use after notice of changes constitutes acceptance.

§ 8 · Governing Law and Jurisdiction

8.1 Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in the EU or the United Kingdom, the mandatory consumer-protection provisions of their respective country of residence remain unaffected.

8.2 The place of jurisdiction is Zurich, Switzerland. Consumers may also bring proceedings before the courts of their place of residence.
